Proposed new legislation will make it easier for police to protect someone who has a protection order against a person who has intimidated, threatened, coerced or harassed them, by amending The Enforcement of Canadian Judgments Act.

General Remarks

  1. Appointments as Notaries Public must be registered with the Ministry of Justice and Attorney General.  Telephone Court Services Branch at (306) 787-4117 if you require assistance.
  2. Only Canadian Citizens or other British Subjects who are 18 years of age or more, and residing within Saskatchewan may be appointed as a Notary Public for Saskatchewan.  
  3. All appointments are discretionary.
  4. The fee for an appointment is $200.00, with these exceptions:

Applications received without the required authorization will be returned to the applicant. 

  1. Please be sure to indicate the reason you require the appointment and how the appointment will fulfill a public need, the types of documents that will be notarized, and the approximate number of documents that will be notarized each month.
     
  2. The Notary Public Application now requires the applicant to disclose any criminal record, provide confirmation of the applicant's criminal record status, and includes consent for the Ministry of Justice and Attorney General to inquire into whether or not the applicant has a criminal record.
     
  3. Please submit the following to this office:
    • The application, completed in full, signed and dated on pages 1 and 2 as required.
    • The completed and signed signature card (page 3 of the application).
    • A cheque for any required fees, payable to the MINISTER OF FINANCE.
    • Confirmation of your criminal record status obtained from the police.

Every applicant for an appointment as a Notary Public should become familiar with The Notaries Public Act and Regulations.

Duties of a Notary Public

A Notary Public may use and exercise the power of drawing, passing, keeping and issuing all deeds and contracts, charter parties and other mercantile documents in Saskatchewan and also of attesting all commercial instruments that may be brought before him/her for public protestation.

Expiry date of appointment

Appointments are for 5-year terms.  The expiry date of all appointments will be noted on the certificate of appointment.  If you wish to continue your appointment, please reapply before the expiry date by filling out the application.

Penalties 

  • A Notary Public whose appointment expires, who fails to write or stamp on every affidavit, declaration or other certificate made before or given by him or her, the date on which his or her appointment expires, is liable on summary conviction to a fine not exceeding $50.00 and costs.
  • Anyone appointed Notary Public, who signs a document or affixes his or her seal, where a seal is necessary, before it has been fully completed with respect to the particulars required for the purposes of the document, shall, upon summary conviction be liable to a penalty of not more than $50.00.

Evidence of Appointment 

Every Notary Public is issued a certificate as evidence of appointment.  If you change your name, you must obtain a new certificate showing your changed name.  For instructions on what is required to change your name on your certificate, please telephone Court Services Branch at (306) 787-4117. 

It is the responsibility of every Notary Public to obtain his or her own stamp or seal.  These devices are not provided by Court Services Branch.  Suppliers can be located in the yellow pages of the telephone directory under "Rubber & Plastic Stamps"
